Overseas travel alert level and consumer rights

In light of the recent outbreaks of influenza A(H1N1) overseas, the Ministry of Foreign Affairs (MOFA) has issued red travel alert for Mexico, advising against travel to Mexico.As a consequence, people who have booked and paid for a vacation to Mexico are entitled to get a refund after deducting the whole of any expenditure made on their behalf according to Clause 28 of the Standardized Contract for Individual Overseas Travel.The following decisions concerning the mechanism for refund associated with travel to Mexico were reached at the meeting held by the Central Epidemic Command Center on May 6, 2009:

1. This meeting was held to establish a mechanism for refund in relation to the ongoing influenza A (H1N1) outbreaks overseas.From then on, the refund mechanism thus established is applicable to all implementation of any relevant overseas travel alert and standardized contract.

2. Clause 28 of the Standardized Contract for Individual Overseas Travel is applicable when a red travel alert is issued.Clause 28-1 of the Standardized Contract for Individual Overseas Travel is applicable when an orange travel alert is issued. Clause 27 of the Standardized Contract for Individual Overseas Travel is applicable when a yellow travel alert, corresponding to the pandemic alert level: Phases 2-3, is issued.However, when a yellow travel alert, corresponding to the pandemic alert level: Phase 4, is issued, the Tourism Bureau will handle the situation on a case-by-case basis and will publish relevant press release as necessary.

3. For independent travel:
a) Airline tickets: please contact the Civil Aeronautics Administration of the Ministry of and Communications (Tel. No.: 0800-211-798).
b) Travel Agency and Hotel: please contact the Tourism Bureau of the Ministry of Transportation and Communications (Tel. No.: 0800-211-734).

4. For flight connection: please contact the Tourism Bureau of the Ministry of Transportation and Communications (Tel. No.: 0800-211-734).

5. For studying abroad: Clause 12 of the Contract for Study Abroad and Study-tour Abroad Program is applicable when a red travel alert or an orange travel alert is issued. Clause 13 of the Contract for Study Abroad and Study-tour Abroad Program is applicable when a yellow travel alert, corresponding to the pandemic alert level: Phases 2-3, is issued.However, when a yellow travel alert, corresponding to the pandemic alert level: Phase 4, is issued, the Ministry of Education will handle the situation on a case-by-case basis and will publish relevant press release as necessary.For study-tour abroad program, Clause 8-1 of the Contract for Study Abroad and Study-tour Abroad Program is applicable when a red travel alert or an orange travel alert is issued.Clause 8 of the Contract for Study Abroad and Study-tour Abroad Program is applicable when a yellow travel alert, corresponding to the pandemic alert level: Phases 2-3, is issued.However, when a yellow travel alert, corresponding to the pandemic alert level: Phase 4, is issued, the Ministry of Education will handle the situation on a case-by-case basis (Tel.
